Terms of Service

01Eligibility

You must be at least 13 years old to use the Service. If you are under 13, you may not create an account or use the Service. By using the Service, you confirm that you meet this age requirement and that the information you provide is accurate.

If you are under the age of majority where you live, you may use the Service only with permission from your parent or legal guardian, and your parent or guardian is responsible for your use of the Service.

02The Service

The Service lets registered users upload photos within the photo library access range they authorize, including photos they select, generate stylized and non-photorealistic 3D avatars or figures using AI tools, place generated avatars on suitable AR surfaces as published works, and allow other registered users to view public published works only when they reach the same physical location and successfully view the work through AR visual positioning, including Google ARCore Cloud Anchors or similar technologies.

The Service currently does not offer paid subscriptions, paid downloads, in-app purchases, virtual currency, or other paid features. If we add paid features in the future, we will provide additional terms and disclosures.

03Accounts and Security

You must register and sign in to use the Service. We currently support Apple and Google sign-in. You are responsible for maintaining the security of your account and for all activity under your account. Notify us promptly at support@dmyh.tech if you suspect unauthorized access.

You may not create an account using false age information, impersonate another person, sell or transfer your account, or use another user's account without permission.

04User Content

"Avatar" means a stylized, non-photorealistic 3D character or figure generated from photos. "Published work" means content created when you place an avatar at a physical location. One avatar may be used to create multiple published works.

"User Content" means content you upload, create, generate, publish, display, or submit through the Service, including photos, AI-generated images, generated reference images, avatars, 3D avatar assets, published works, screenshots or previews, published work captions, likes, account information such as nickname and profile photo, reports, and related metadata.

You are responsible for your User Content. You represent and warrant that:

• you have the rights, permissions, and authority needed to upload, generate, publish, and display your User Content;
• your User Content does not violate another person's privacy, publicity, intellectual property, or other rights;
• your User Content does not violate these Terms, our Community and UGC Policy, or applicable law;
• you will not use the Service to harass, bully, threaten, exploit, impersonate, or deceive others.

05License You Grant Us

You keep ownership of your User Content, subject to the rights of others and applicable law. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, adapt, modify, create derivative works from, display, publish, transmit, moderate, remove, and otherwise use your User Content for the purpose of operating, improving, securing, and promoting the Service.

This license includes the right to process uploaded photos and related inputs through third-party AI providers to generate stylized images and 3D avatar assets. We do not use your uploaded photos, generated images, avatars, or published works to train our own AI models.

When you delete User Content or your account, this license ends for future use, except where continued use is reasonably necessary for legal compliance, safety, dispute resolution, enforcement, technical operations, asynchronous cleanup of public or AR/spatial data, or content already shared with other users in ways we cannot reasonably recall.

06AI-Generated Outputs

AI-generated outputs may be inaccurate, unexpected, or similar to outputs generated for other users. You are responsible for reviewing outputs before publishing them. We may refuse, filter, modify, remove, or restrict outputs that violate our policies or law.

The Service creates stylized, non-photorealistic avatars. You may not use the Service to create misleading impersonations, unauthorized representations of another person, sexualized content involving a real person, harassment, or content that violates another person's rights.

07Published Works and AR Placement

When you publish a work, other registered users may view it only after they reach the same physical location and successfully view the work through the Service's AR visual positioning features. Your nickname, profile photo, published work caption, display place label, public like count, screenshots or previews, and other public information may be visible with the work. If you like another user's published work, that work's owner may see that you liked it, including your nickname and profile photo in notifications.

You may not place published works in a way that creates safety risks, invades privacy, targets or harasses individuals, misleads users, encourages trespassing, or violates law or venue rules.

08Capturing Content Outside the Service

The current version does not provide an in-app sharing feature. However, users may still save, record, screenshot, or otherwise capture certain avatars, published works, published work captions, likes, or AR experiences by using device features outside our control.

If you capture or distribute content from the Service outside the Service, you are responsible for that conduct. You must not do so in a way that violates law, infringes rights, invades privacy, harasses or bullies others, misleads viewers, removes required attribution or context, or violates these Terms or our Community and UGC Policy.

Deleting content from the Service does not guarantee removal of copies, screenshots, recordings, links, or reposts that other users or third parties have already saved or shared outside the Service.

Deleting a published work does not delete the avatar used in that work or the source photos and generated assets associated with that avatar. Deleting an avatar does not automatically delete published works already created with that avatar. To remove a work from a location, delete that published work separately where the feature is available.

09Prohibited Conduct

You may not:

• violate law or the rights of others;
• upload or publish content that is pornographic, sexually exploitative, hateful, violent, threatening, harassing, bullying, self-harm promoting, illegal, or otherwise harmful;
• upload photos of another person without necessary rights or permission;
• impersonate another person or falsely imply affiliation with another person, brand, or organization;
• use the Service to identify, track, stalk, or endanger another person;
• scrape, crawl, reverse engineer, or interfere with the Service;
• bypass moderation, reporting, age-gating, or security features;
• submit false reports or abuse the reporting system;
• upload malware or attempt unauthorized access;
• use the Service for spam, scams, phishing, or deceptive activity;
• share another user's content outside the Service in a way that harasses, shames, sexualizes, impersonates, doxxes, or otherwise harms them.

10Moderation and Enforcement

We may use automated and manual review to moderate content and enforce these Terms. We may remove content, limit visibility, disable features, suspend or terminate accounts, preserve information, or report activity to authorities when we believe it is necessary to protect users, the Service, or others.

You can report published works, published work captions, unsafe AR placements, or other available content in the app or at safety@dmyh.tech. We may take action against the associated account where appropriate. You may appeal certain enforcement decisions by contacting safety@dmyh.tech.

11Intellectual Property

The Service, including software, design, trademarks, logos, and other materials provided by us, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

12Third-Party Services

The Service may rely on or link to third-party services, including Apple, Google sign-in, Google ARCore Cloud Anchors, Google Maps Platform, Google Places, AI providers, AWS cloud infrastructure in us-east-1, analytics providers, moderation vendors, and VPS or AR technology providers. Their services may be governed by their own terms and privacy policies.

13Account Deletion

You may delete your account in the app where available or contact support@dmyh.tech for help. When you delete your account in the app, your account is deleted immediately from the active account system, and we begin deleting or anonymizing associated account information and user content. Some public content, AR/spatial data, Cloud Anchors, world maps, screenshots or previews, interaction records, telemetry, diagnostics, and technical records may be cleaned up asynchronously or retained for a limited period where needed for legal compliance, safety, dispute resolution, enforcement, or technical operations.

14Disclaimers

The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, secure, or that AI outputs or AR placement will be accurate, stable, or suitable for your intended use.

15Limitation of Liability

To the maximum extent permitted by law, Shanghai One Line Technology Co., Ltd. and its affiliates, officers, employees, agents, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from or related to the Service.

16Changes

We may update these Terms from time to time. We will post the updated Terms with a new effective date. Continued use of the Service after changes become effective means you accept the updated Terms.
